Many contemporary human rights theorists argue that we can establish the normative universality of human rights despite extensive cultural and moral diversity by appealing to the notion of overlapping consensus. In this paper I argue that proposals to ground the universality of human rights in overlapping consensus on the list of rights are unsuccessful. I consider an example from Islamic comprehensive doctrine in order to demonstrate that apparent consensus on the list of rights may not in fact constitute meaningful agreement (...) and may not be sufficient to ground the universality of human rights. I conclude with some general suggestions for establishing the universality of human rights. The present article argues that rethinking the mission of moral epistemology requires rethinking its method as well. Philosophers cannot learn which reasoning practices are suitable to use in particular contexts exclusively by exploring logical relations among concepts. Instead, (...) in order to understand which reasoning practices are capable of justifying moral claims in different types of contexts, we need to study empirically the relationships between reasoning practices and the contexts in which they are used. The article proposes that philosophers investigate case studies of real‐world moral disputes in which people lack shared cultural assumptions and/or are unequal in social power. Drawing from our interdisciplinary qualitative study of LGBTI conservative Christians and their allies, we name an especially toxic form of shame—what we call sacramental shame—that affects the lives of LGBTI and other conservative Christians. Sacramental shame results from conservative Christianity's allegiance to the doctrine of gender complementarity, which elevates heteronormativity to the level of the sacred and renders those who violate it as not persons, but monsters. In dispensing shame as a sacrament, nonaffirming Christians require constant displays of shame as (...) proof that LGBTI church members love God and belong in the community. Part of what makes this shame so harmful is that parents and pastors often dispense it with sincere expressions of care and affection, compounding the sense that one's capacity to give and receive love is damaged. We foreground LGBTI Christian movements to overcome sacramental shame by cultivating nonhubristic pride, and conclude by discussing briefly their new understandings of love and justice that could have far‐reaching benefits. En las tres últimas décadas del siglo XX, muchos filósofos analíticos han abordado cuestiones de ética práctica, ampliando radicalmente el campo de la filosofía moral más allá de los temas metaéticos que habían sido su foco principal durante la mayor parte del siglo. Sin embargo, abordar este tipo de controversias prácticas rápidamente hizo surgir la cuestión de cómo justificar las afirmaciones morales normativas. Muchos filósofos analíticos se basaron en el intuicionismo, que tiene un linaje muy antiguo dentro de la filosofía (...) moral anglófona. Este artículo evalúa tres formas en las que los filósofos analíticos del siglo XX recurrieron a las intuiciones para apoyar o rebatir las afirmaciones morales. Argumentamos que esos métodos fracasaron en su objetivo de promover un conocimiento moral digno de confianza porque se basaron en supuestos que, cuando se presumen en contextos de injusticia epistémica estructural, son sistemáticamente engañosos. A pesar de que las intuiciones se encuentran entre las fuentes de conocimiento en las que los agentes morales deben confiar, la epistemología moral debe prestar especial atención a los procesos sociales a través de los cuales se recogen, refinan y evalúan las intuiciones y otras formas de evidencia. Producir un conocimiento moral digno de confianza requiere procesos de razonamiento democráticos que sean sensibles a la omnipresencia de la injusticia epistémica y la dominación, así como desarrollar estrategias para contrarrestarlas. A literary criticism is presented of the book "Challenging Liberalism: Feminism As Political Critique," by Lisa Schwartzman, in response to a symposium devoted to her book. The author comments on feminist theory's criticism of liberalism and the potential for feminist methodology to address the oppression of women globally. Topics include the argument for women's rights as human rights and criticism of the women's rights movement by African scholars, as well as a discussion of the Massai tribe.

Sociologists studying gender have debated West and Zimmerman’s premise that “doing gender is unavoidable,” seeking to ascertain whether people can “undo” or only “redo” gender. While sociologists have been correct to focus on the interactional accomplishment of gender, they have neglected one of Garfinkel’s key insights about interaction: that people hold each other accountable to particular narratives. Neglecting the narrative aspect of doing—and undoing—gender impedes our ability to recognize processes of social change. Based on a qualitative study, we show how (...) the movement for LGBTQI acceptance within U.S. conservative Protestant churches works to make gender not “omnirelevant” by challenging conservative “complementarity” narratives that posit two complementary, opposite sexes as a commandment preceding the Ten Commandments in time and importance. We explore this movement’s ambivalent relationship with homonormativity, highlight three ways this movement resists projecting binary gender narratives into scripture, and examine how some in this movement see the pursuit of social justice as a Christian mandate. The efforts of LGBTQI conservative Christians exemplify how reshaping sex/gender/sexual narratives can create possibilities for undoing gender. (shrink)

Clergy sexual abuse is both sexual and psychological violence, but it is also a paradigmatic case of spiritual violence that rises to the level of religious trauma. In this paper I argue that the spiritual violence of clergy sexual abuse diminishes, and in some cases may even destroy, a survivor’s capacities for religious faith or other forms of spiritual engagement. I use and illustrate the value of feminist methodology, as developed and advanced by Alison Jaggar, for generating and pursuing philosophical (...) questions about religious experience. Feminist methodology’s sensitivity to theorizing situated subjects who stand to each other in relations of racialized male dominance helps us see the ways in which clergy sexual abuse is gender-based violence in both its causes and effects. It also helps us both ask and answer questions about religious faith in the unjust meantime from the perspective of those who endure spiritually violent faith communities. (shrink)

While some philosophers suggest that mystical experience may provide evidence for belief in God, skeptics doubt that there is adequate warrant for even accepting the claim of a mystical experience as evidence for anything, except perhaps for some kind of mental instability. Drawing from the work of Gabriel Marcel, I argue that the pervasive philosophical skepticism about the evidential status of mystical experiences is misguided because it rests on too narrow a view about ways of knowing and about what can (...) count as evidence for belief in the divine. I illustrate the advantages of Marcel’s approach by applying it to the respective spiritual journeys of Augustine of Hippo and Abu Hamid Muhammad al-Ghazali. I then argue that Marcel’s framework improves on contemporary analytic approaches because it captures more accurately the kind of knowledge that mystical experiences convey as reported by the subjects who claim to have them. In Book VI of his Confessions, Saint Augustine offers a detailed description of one of the most famous cases of weakness of will in the history of philosophy. Augustine characterizes his experience as a monstrous situation in which he both wills and does not will moral growth, but he is at odds to explain this phenomenon. In this paper, I argue that Aquinas’s action theory offers important resources for explaining Augustine’s monstrosity. On Aquinas’s schema, human acts are composed of various (...) operations of intellect and will, and thus are subject to disintegration. In order to capture the gap in human action between making choices to pursue particular goals and translating those choices into behavior, Aquinas distinguishes between two operations of will that he calls choice and use. I apply hisdistinction between choice and use to Augustine’s case, arguing that Augustine’s moral weakness is a result of will’s failure to use its choices. The central thesis of this paper is that Augustine’s monstrosity is a bona fide case of weakness of will that is best explained as a failure in use at the level of will. (shrink)

In this paper, I argue that relationships of trust are often necessary for moral justification. Even if a moral claim is likely to be true, it may not be adequately justified, and thus may not have normative force, unless those who are to accept the claim have good reason to believe that the one entering the claim is a trustworthy moral interlocutor. The complexity of moral knowledge coupled with differences among people in moral experience, capacities for moral perception, and reasoning (...) abilities creates relations of epistemic dependence that make trust necessary in order to achieve adequate moral justification. One popular strategy of opposition to practices of female genital cutting (FCG) is rooted in the global feminist movement. Arguing that women’s rights are human rights, global feminists contend that practices of FGC are a culturally specific manifestation of gender-based oppression that violates a number of rights. Many African feminists resist a women’s rights approach. They argue that by focusing on gender as the primary axis of oppression affecting the African communities where FGC occurs, a women’s rights approach has misrepresented (...) African women as passive victims who need to be rescued from African men and has obscured the role of certain international institutions that have perpetuated the oppression of African women. In this paper, I defend these critiques by arguing that the use of a women’s rights framework to combat practices of female genital cutting among African communities has often been practically ineffective and morally inappropriate. Introduction. Medical trainees fear disclosing psychological distress and rarely seek help. Social sharing of difficult experiences can reduce stress and burnout. Drawing comics is one way that has been used to help trainees express themselves. The authors explore reasons why some medical trainees chose to draw comics depicting stressful situations that they had never shared with anyone before. Methods. Trainees participated in a comic drawing session on stressors in medicine. Participants were asked if they had ever shared the drawn situation (...) with anyone. Participants who had not previously shared were asked what prevented them and why they shared it now. The authors performed content analysis of the responses. Results. Of two hundred forty participants, forty-six indicated sharing an experience for the first time. Analysis of the responses revealed dedicated time and space was essential to sharing, trainee insecurity was a barrier, and comics were perceived as a safe way to communicate. Discussion. Depicting a stressful situation may be beneficial for trainees who drew an experience they had never shared before. Providing trainees with the opportunity to externalize their experience and create a community for sharing tough experiences may be one way to reduce trainee stress and burnout. (shrink)

Even though sign-systems are a crucial part of society, critical realism, as developed by Roy Bhaskar, does not yet have an adequate theory of signs and semiosis. The few suggestions that Bhaskar offers can be advanced through the semiotics of C.S. Peirce. In doing so, however, it becomes necessary to reconsider Bhaskar's ontological domains of the real, the actual, and the subjective, and expand the last domain into one of semiosis. This new understanding of ontological domains, incorporating Peirceian semiotics, provides (...) the basis for rethinking the ontology of society: the customary dyad structures/agents becomes the triad structures/agents/discourses, each of which possesses material, sociological, and meaningful aspects. Critical posthumanism is an invitation to think differently about knowledge and educational relationality between humans and the more-than-human. This philosophical and political shift in subjectivity builds on, and is entangled with, poststructuralism and phenomenology. In this paper we read diffractively through one another the theories of Finnish architect Juhani Pallasmaa and feminist posthumanists Karen Barad and Rosi Braidotti. We explore the implications of the so-called ‘ontological turn’ for early childhood education. With its emphasis on a moving away from the dominant (...) role of human vision in educational research we show how videoing and photographing works as an apparatus in an analysis of data from an inner-city school in Johannesburg, South Africa. We are struck by children’s seeing with the ‘eyes of their skin’ and ‘seeing’ with/in the world, as their obvious distress is felt when a small tree sapling has been mowed down in a nearby park. We analyse the event with the help of a variation on Deleuze’s notion of ‘becoming-child’: ‘becoming-little’, and Anna Tsing’s ‘the arts of noticing’. ‘Becoming-little’ as a methodology disrupts the adult/child binary that positions ‘little’, younger humans as inferior to their ‘bigger’ fully human counterparts. We exemplify ‘becoming-little’ through 4 and 5 year-olds’ learning with the little tree and adopt Barad’s temporal diffraction to ‘see’ what is in/visible in the park: the extractive, exploitative, colonising mining practices of White settlers. These are still part of the land on which the park was created but are in/visible beneath the ‘skin’ of the earth. (shrink)

The concerns regarding patient autonomy presented in August A. Culbert et al.’s “Navigating Informed Consent and Patient Safety in Surgery: Lessons for Medical Students and Junior Trainees” fall just short of addressing the main issue. Patient autonomy is not something that just one member of a team should consider, and it should not be something that any protocol should have the power to subvert, particularly in an environment as tenuous as the operating room. This article will take the concerns regarding (...) the ethics of removing a patient’s hearing aid prior to entering the operating room presented in the aforementioned article and show the necessity for a new standard operating procedure. Medical Officers serving with their national contingents in peacekeeping operations are faced with difficult ethical decisions in regard to their obligations to the local civilian population. Such populations may be under-resourced in regard to medical care, and vulnerable to abuse and exploitation. Though the medical officer may support the local medical services, he/she should never undermine these resources. Adopting a human rights approach and observing the requirements of ethical medicine, aids the doctor in prioritising his/her duties. At times there may (...) be conflict with one’s own military superiors. It is wise to discuss potential difficulties prior to setting out on the mission. Human rights abuses cannot be ignored. The medical officer has a duty to do his/her best to report their observations so as to prevent abuse or to bring it to an end. (shrink)

As políticas de privatização da educação e as formas pelas quais se materializam têm assumido contornos sem precedentes no tempo presente e são emblemas das mutações da face social do Estado no provimento e garantia do direito humano à educação, como consequência da ascensão e capilaridade dos princípios neoliberais no tecido social que se apoiam, por sua vez, na primazia do capital financeiro e na concentração da riqueza. No Brasil, o direito à educação é matéria do texto constitucional nos títulos (...) “II – Dos direitos e garantias fundamentais” e “VIII – Da ordem social” (BRASIL, 1988), além de outras disposições e tangencia, em maior ou menor medida, todas as legislações infraconstitucionais. Pelo fato de ser fundante e crucial para a garantia do direito humano à educação, a defesa da oferta, currículo e gestão da educação pela esfera pública constitui-se em uma pauta candente para as pesquisas acadêmicas e para o ativismo social, uma vez que se trata da defesa de direitos em risco e de contraposições às mecânicas de poder que contribuem para a corrosão da esfera pública. Balanços analíticos e interpretativos de evidências empíricas, realizadas por pesquisadores sobre o fenômeno da privatização da educação em diferentes países e territórios têm desvelado reconfigurações normativas, práticas gestoriais e desenhos curriculares elucidando a magnitude do alcance das políticas e práticas mercantis e privatistas no âmbito educacional, em escala mundial. As reformas educacionais de cariz privatista induzidas por atores privados têm sido orquestradas por regimes ou modelos de governança da educação denominados como “governo empresarial” por Dardot e Laval (2016), como gestão corporativa da educação (Croso e Magalhaes, 2016) ou ainda por parcerias público-privadas (Robertson e Verger, 2012). Em substância, os processos privatistas se concretizam mediante uma apropriação teórico-prática das políticas educacionais de forma orgânica e multiforme, incidindo sobre a gestão escolar; a formação de docentes e de gestores; assessorias pedagógicas; a oferta de tecnologias educacionais; os sistemas privados de ensino que padronizam projetos curriculares, dentre outros insumos pedagógicos, além do incentivo à programas de escolha parental que disputam os fundos públicos (Adrião, 2018). Essa miríade de formas de privatização da educação ocasiona efeitos nefastos à consolidação da educação como direito público e subjetivo, conquista consagrada em cartas constitucionais da grande maioria dos países do globo, dentre outros códigos legais. No Brasil, pesquisa financiada pela FAPESP e desenvolvida no âmbito da Rede Latino-Americana e Africana de Pesquisadores em Privatização da Educação (ReLAAPPe) sob coordenação geral de Theresa Adrião intitulada Mapeamento das Estratégias de Privatização da Educação Básica no Brasil e coordenada em nível estadual por pesquisadores/as de treze instituições públicas de pesquisa de diferentes regiões do país, mapeia e analisa tendências de privatização materializadas nas redes educacionais dos estados e do Distrito Federal, nas dimensões da oferta educativa, gestão educacional e do currículo (Adrião, 2018)[1]. A pesquisa elucidou a inserção de organizações privadas, fundamentalmente de natureza empresarial, na definição e ou operacionalização de programas educacionais sob a tutela dos entes subnacionais entre 2005 e 2018. Face ao avanço dos multifacetados formatos da privatização da educação, o presente dossiê revela elementos para a problematização do modus operandi do setor privado na escola pública em distintos contextos, de maneira a focalizar criticamente dimensões contíguas entre esta efeméride e a agenda globalmente estruturada para a educação (DALE, 2004). Trata-se de um esforço coletivo derivado de ações investigativas conectadas ao supracitado coletivo de pesquisa para dar visibilidade à teleologia empresarial que tem se reverberado na esfera pública, cuja aquiescência de governos ultraconservadores e determinações históricas da conjuntura atual têm encarregado de conformar. As análises aqui disponibilizadas constituem-se em importantes alternativas analíticas para dissipar narrativas hegemônicas que produzem colapsos na cidadania e nos Direitos Humanos dos estratos historicamente empobrecidos. After thirty-five years of teaching and administrating at Princeton University, dozens of books, and innumerable articles, the eminent Germanist Theodore Ziolkowski has turned his attention to a (...) theme appropriate for someone so immersed in the intellectual life: the sorrow and grief that accompany human knowledge. Although Ziolkowski has made great contributions in standard studies of genre (notably the elegy and the twentieth-century novel) and authors (Mann, Hesse, and Broch), he became especially well known for his theorization and implementation of thematic studies, ranging from the sublime--fictionalizations of the life of Jesus--to the humorous--talking animals in literature. The figures whom Ziolkowski has selected for analysis of the sin of knowledge are Adam, Prometheus, and Faust, each of whom he views through both an ancient and a modern lens.All three of these mythic heroes violate "divine prohibitions against the new knowledge" (p. 69). Less heroically, all of these myths treat women misogynistically. Generally, Ziolkowski sees each of these stories as having emerged in a time of crisis, when new opportunities presented humanity with knowledge both alluring and disruptive. Because these are highly elastic myths, able to provide meaning in a variety of contexts, they have all mutated in modern times. Adam's Fall comes to represent the human transition from innocence to consciousness, Prometheus becomes a symbol for socialism's promise, and Faust turns into a representative of the American way of life.Looking at the ancient legend of Adam, Ziolkowski notes that sexuality and wisdom are linked in many of the oldest texts in humanity's recorded history. The emphasis on knowledge, however, is especially strong in the Hebrew myth. While many Near Eastern traditions have stories with similarities to the Biblical account of Adam and Eve, only Hebrew mythology has the Tree of Knowledge. For Ziolkowski, the fact that this story was probably set down during the reign of King Solomon explains this emphasis on knowledge. Because the Age of Solomon was a time of unparalleled wealth and power for the Hebrews, [End Page 347] Ziolkowski argues that the tale of Adam and Eve is the kind of myth "produced by cultures that have reached a certain level of sophistication... and look back with a degree of nostalgia at an imagined simpler, happier existence" (p. 23). According to Ziolkowski, knowledge becomes a sin for the Hebrews as they come to terms with the limitations of everything that their knowledge has brought them even at the height of their power and glory.In the modern era, Ziolkowski continues, the story of Adam has become secularized, representing the transition of humanity from a state of innocence to one of consciousness. He finds references to the Fall in Voltaire's Candide, Kleist's The Broken Pitcher, E. T. A. Hoffmann's The Golden Pot, Melville's Billy Budd, and Hesse's Demian. The overall trend of these representations of the rise of consciousness has been increasingly negative, culminating in sentiments like those expressed by the East German author Günter Kunter, who argues that "our whole present misery and all the problems of industrial civilization" can be linked to "the moment when man used the first firestone as a tool, the Fall" (p. 107). Mathematical notation includes a vast array of signs. Most mathematical signs appear to be symbolic, in the sense that their meaning is arbitrarily related to their visual appearance. We explored the hypothesis that mathematical signs with iconic aspects—those which visually resemble in some way the concepts they represent—offer a cognitive advantage over those which are purely symbolic. An early formulation of this hypothesis was made by Christine Ladd in 1883 who suggested that symmetrical signs should be used to convey commutative (...) relations, because they visually resemble the mathematical concept they represent. Two controlled experiments provide the first empirical test of, and evidence for, Ladd's hypothesis. In Experiment 1 we find that participants are more likely to attribute commutativity to operations denoted by symmetric signs. In Experiment 2 we further show that using symmetric signs as notation for commutative operations can increase mathematical performance. (shrink)

Individuals with high levels of narcissism often ascend to leadership positions. Whereas there is evidence that narcissism is linked to unethical behavior and negative social outcomes, the effects of leader narcissism on an organization’s most important resource—its employees—have not yet been studied thoroughly. Using theoretical assumptions of the Narcissistic Admiration and Rivalry Concept and social exchange theories, we examined how leaders’ narcissistic rivalry was related to follower outcomes in a sample of matched leaders and followers. Followers of leaders high in (...) narcissistic rivalry reported less perceived supervisor support, lower quality leader-member relationships, lower performance-based self-esteem, and lower job engagement. These effects were only found when follower-rated leaders’ narcissistic rivalry was used in the model but not when self-rated leaders’ narcissistic rivalry was used as a predictor. This implies that the negative effects of leaders’ narcissistic rivalry on followers are driven by the expression of narcissistic tendencies. Leader development should thus focus on changing destructive leader behavior. We propose that leaders high in narcissistic rivalry can be motivated to make such changes by showing them that by hurting their followers, they will eventually undermine their own reputation and status. Furthermore, selection and promotion practices should incorporate objective measures to weaken the effects of narcissists’ self-promotional tactics in these contexts and thus prevent people high in narcissistic rivalry from rising to leadership positions. In an increasingly globalized food economy, local agri-food initiatives are promoted as more sustainable alternatives, both for small-scale producers and ecologically conscious consumers. However, revitalizing local agri-food communities in rural agro-industrial regions is particularly challenging. This case study examines Grant and Chelan Counties, two industrial farming regions in rural Central Washington State, distant from the urban fringe. Farmers in these counties have tried diversifying large-scale processing into organics and marketing niche and organic produce at popular farmers markets in Seattle about (...) 200 miles away. Such strategies invoke the question, “How are ‘local’ agri-food networks socially and geographically defined?” The meaning of what constitutes “local” and/or “sustainable” systems merits consideration in the linking of these rural counties with distant urban farmers markets. Employing historical, in-depth interview and survey research, we analyze production and consumption networks and the non-market systems that residents in these counties access for self-provisioning and food security.
